(We've seen it happen. More than once.) If there is, and it's been trademarked, you can be sued for trademark infringement even if it's not exactly the same as yours. You don't want to be finding out about a similar design after you've started using yours. You want to be finding out about it now, before you put any more time or money into the logo you already have.
We go directly to the U.S. trademark designs database
for our searches. One of our registered trademark agents
will carefully analyze your logo and search on the various
design elements involved, and then review every citation
resulting from these searches, which often means examining
hundreds of designs. We provide you with a report including
our Official Opinion as to whether the proposed logo is a
good candidate for registration. This Opinion is at the heart
of our report and relies on years of experience and an understanding
of the complex law of trademarks.

Also, please send us a good quality copy of your logo by

make sure it's big enough to make out the details (600 x 800 pixels or bigger, but no larger than 2MB), preferably in jpg or gif format. If there are colours involved, send us a version in colour.
